Terms of Use — Musicsesame Library
1) Acceptance of Terms
By accessing, previewing, downloading, licensing, or otherwise using any audio, music, stems, loops, artwork, text, or metadata available through the Musicsesame Library (the “Library”), you agree to these Terms of Use (“Terms”). If you do not agree, you may not use the Library.
2) Who We Are
The Library is owned and operated by TMC Publishing Limited (“we”, “us”, “our”) - C/O The Accountancy Partnership Twelve Quays House, Egerton Wharf, Wirral, United Kingdom, CH41 1LD. All content in the Library is owned by TMC Publishing Limited and/or its licensors.
3) License & Access
You may only use Library content if you (a) hold an active subscription on the correct plan, or (b) have received a written license confirmation from us. Without such authorization, any use is strictly prohibited and constitutes copyright infringement under applicable law.
Plans define where and how content may be used (e.g., number of YouTube channels that may be whitelisted, scope of social media use, commercial scope). Using content beyond your plan’s scope requires an upgrade or a separate license from us.
4) Prohibited Uses
- Any use without an active subscription or written license.
- Re-distribution, re-uploading, sharing, reselling, sublicensing, or making the files available in any library, template, app, or repository.
- Claiming ownership/authorship of the music or attempting to alter/remove audio fingerprints or rights management.
- Use in unlawful, defamatory, or infringing content.
- Training or creating AI models from the audio or metadata.
5) Ownership
All recordings, compositions, performances, artwork, metadata, and related materials remain the exclusive property of TMC Publishing Limited and/or our licensors. No ownership is transferred to you. When granted, your rights are limited to a revocable, non-exclusive, non-transferable license defined by your plan or license document.
6) Subscriptions, Upgrades & Whitelisting
Certain plans allow whitelisting of specific YouTube channels for Content ID purposes. Whitelisting is only valid for channels listed on your plan. To add channels, you must upgrade to a plan that includes additional whitelists or obtain written approval from us. Use across other social media is permitted only as specified by your active plan.
7) Content ID Claims & Removals
Content ID claims may appear on platforms such as YouTube. If you have an active license and need a removal or channel whitelist, contact info@musicsesame.com with your video URL, channel handle, and claim reference.
8) Attribution
Attribution is appreciated where possible. If a specific track or license requires attribution, you must follow the provided credit language.
9) Termination
We may suspend or terminate access for breach of these Terms. Upon termination or expiry of your plan, your license ends and you must cease any new uses of the content. Existing uses may require a new license unless explicitly stated otherwise by us in writing.
10) Warranties & Liability
The Library is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties and limit our aggregate liability to the fees you paid in the twelve (12) months preceding the claim.
11) Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute arising from or relating to these Terms or your use of the Library.
12) Changes to These Terms
We may update these Terms from time to time. Continued use of the Library after changes take effect constitutes acceptance of the updated Terms.
